Terms of Service

1. Acceptance of Terms

By accessing or using MayaHue ('the Platform'), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. We may update these terms at any time; continued use after changes constitutes acceptance.

2. Account Registration

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate, complete information and notify us immediately of any unauthorized use.

3. Buyer Terms

When you purchase an item on MayaHue, you enter into a direct contract with the seller. The Platform facilitates the transaction but is not a party to the sale. Buyers agree to:

• Provide accurate shipping and payment information.
• Pay the full amount specified at checkout.
• Not attempt to circumvent platform fees or payment systems.
• Communicate respectfully with sellers.
• Open a dispute within 30 days if an issue arises.

4. Seller Terms

Sellers agree to:

• List only items that are handmade, vintage (20+ years), or craft supplies.
• Provide accurate descriptions, photos, and pricing.
• Fulfill orders within the stated production time.
• Respond to buyer messages within 48 hours.
• Not list prohibited items (see Section 5).
• Pay applicable platform fees on completed sales.

5. Prohibited Items

The following may not be listed on MayaHue:

• Illegal items or products that violate any applicable law.
• Weapons, ammunition, or explosives.
• Drugs, drug paraphernalia, or controlled substances.
• Hateful, discriminatory, or violent content.
• Counterfeit goods or unauthorized reproductions.
• Items infringing on intellectual property rights.
• Mass-produced items that are not handmade, vintage, or supplies.
• Digital goods that could be used for fraud or deception.

6. Fees and Payments

MayaHue charges a transaction fee of 5% on each completed sale, plus payment processing fees. Listing items is free. Fees are deducted at the time of sale. All fees are non-refundable except as required by law. Sellers are responsible for reporting income to their tax authority.

7. Dispute Resolution

Buyers and sellers are encouraged to resolve disputes directly. If a resolution cannot be reached, either party may open a case with MayaHue within 30 days of the expected delivery date. The Platform will review the case and may issue a decision, including full or partial refunds. All disputes are governed by the laws of the State of California, without regard to conflict of law provisions.

8. Intellectual Property

The MayaHue name, logo, and platform design are trademarks of MayaHue. Content uploaded by users remains their property. By listing on MayaHue, you grant the Platform a limited license to display your content for marketplace functionality. You may not use the Platform to infringe on others' intellectual property.

9. Limitation of Liability

MayaHue is provided 'as is' without warranties of any kind. The Platform is not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the fees paid by you in the 12 months preceding the claim. We are not responsible for the actions of buyers or sellers on the Platform.

10. Termination

We may suspend or terminate accounts that violate these terms, engage in fraudulent activity, or harm the marketplace community. Users may delete their account at any time via account settings. Upon termination, you must cease using the Platform. Outstanding transactions must still be completed.
